BURKE, WHILE SERVING ON THE BOARD OF TRUSTEES OF A REGISTERED INVESTMENT COMPANY, DID NOT HAVE, AND CONSEQUENTLY DID NOT EVALUATE, ALL OF THE INFORMATION REQUESTED AS REASONABLY NECESSARY BEFORE APPROVING CERTAIN INVESTMENT ADVISORY CONTRACTS AT A MEETING ON OCTOBER 1, 2008. Status: Final Sanction Detail: WITHOUT ADMITTING OR DENYING WRONGDOING, MR. BURKE CONSENTED TO THE ENTRY OF AN ORDER OF THE SECURITIES AND EXCHANGE COMMISSION FINDING THAT MR. BURKE, WHILE SERVING ON THE BOARD OF TRUSTEES OF A REGISTERED INVESTMENT COMPANY, DID NOT HAVE, AND CONSEQUENTLY DID NOT EVALUATE, ALL OF THE INFORMATION REQUESTED AS REASONABLY NECESSARY BEFORE APPROVING CERTAIN INVESTMENT ADVISORY CONTRACTS AT A MEETING ON OCTOBER 1, 2008.
